Work and Business Visas
A work visa allows you to live in the US and work for a specific employer. The visa is granted for a limited time but can be extended for years. We assist in submitting the necessary documents from both the employer and employee sides, extending the visa, and bringing the employee’s spouse and minor children to the US as dependents.
The E-2 investor visa is granted to those who want to buy or establish a business in the US and manage it. The business can be a small retail venture or a large company. To obtain the visa, a business plan with the investment size and proof that the business profits will support the investor, their immediate family, and any Israeli employees coming with the visa to manage or operate the business must be presented. The visa is granted for two years and can be extended as long as the business is active.
Our office assists with drafting the business plan and presenting the necessary documents to the immigration authorities, as well as renewing the visa beyond the initial validity (two years).
The E-1 trader visa is intended for an employee or owner of a business engaged in substantial trade with the US. There is no requirement to buy or establish a business in the US or employ American workers. The visa is granted for 52 months and can be extended. E1 visa holders can bring their spouses and children as dependents to the US during their stay.
E1 and E2 visas are non-immigrant visas and do not lead to a Green Card after staying in the US with these visas.
The L-1 visa allows companies to transfer managers and experts from Israel (or another country where the company operates) to a branch, subsidiary, or affiliate in the US. Separate approval can be obtained for each employee transferring to the US, or a blanket petition can be submitted for managers and experts in a specific company, significantly shortening the process of obtaining the L-1 visa.
The O-1 visa is for individuals with extraordinary ability – athletes, scientists, artists, creative individuals, etc. There is a wide range of extraordinary abilities on which this visa application can be based, but applicants must prove that they are recognized as talented – publications, professional certificates, public recognition, etc.
Green Card and Citizenship
You can obtain a Green Card based on family or spousal relationship – marriage or engagement. Green Cards for parents and children are processed relatively quickly compared to Green Card applications for siblings, who must wait for over a decade.
Applicants for a spousal Green Card must prove that the marriage is not fraudulent – we help clients prepare for submitting documents and interviews where they must prove this.
Additionally, a Green Card can be obtained after staying in the US for several years with specific work visas, but not the E2 visa.
A Green Card is essentially a permit to reside in the US for ten years. After obtaining a Green Card and residing in the US as a permanent resident for several years, you can continue to naturalization.
Children and grandchildren of US citizens are also eligible for US citizenship under certain conditions, even if born abroad. In many cases, we can help a parent or grandparent prove that they indeed resided in the US for several years as adults, making their descendants eligible for citizenship.
Finally, if you have left the US and do not intend to return to live within its borders, we assist in the process of renouncing the Green Card and citizenship, which among other things allows you to say goodbye to the obligation to report income to the US tax authorities.
Immigration Violations and Criminal Background
Individuals with previous immigration violations – those who stayed in the US beyond their visa’s validity without extending it, or were caught working illegally during a tourist visit – often face entry restrictions or denial for several years, with longer periods for more severe violations.
Individuals with criminal records in Israel or another country may also encounter difficulties in entering the US and the immigration process to the United States.
